Any person who registers with Wood N Workshop Pty Ltd through the Wood N
Workshop website (“this website“) agrees to all terms and conditions
stated below.

General Terms
Agreement to all terms and conditions remains in force for the entire
duration of a person’s registration as a user of this website.
Furthermore, the terms and conditions relating to exclusion of liability
and indemnity survives after your registration has been cancelled.

Wood N Workshop Pty Ltd reserves the right to vary the \\"Terms &
Conditions of Use\\" of this website at any time whatsoever.

Purpose of this Website
This website is an online catalogue, presenting products available for
purchase, including description, price, and ordering information. Every
care is taken to ensure that the information on this website is accurate
and current. In the event that a product remains in this catalogue when
it is temporarily out of stock or is no longer available, Wood N
Workshop Pty Ltd has no liability or responsible for its failure to make
available for sale any requested product/s.

Images of products on this website are for illustrative purposes only;
the product descriptions should be referred to for the specific
information about the function and features of each product.

The advertising of products on this website is an “invitation to treat”
from Wood N Workshop Pty Ltd to you. An ‘invitation to treat’ is not a
contractual offer.

By submitting an order through this website you are making a contractual
offer. A binding contract is not formed until your offer is accepted by
Wood N Workshop Pty Ltd.

Acceptance of your offer will be by written notice, to the email address
supplied in your registration form, confirming that the item/s is in
stock, the prices of the item/s requested for purchase and the delivery
method and cost.

The only language in which Wood N Workshop Pty Ltd offer this Acceptance
is English.

Price and Payment
The prices contained on this site are the advertised price, as an
invitation to treat only. All prices include Goods and Services Tax.
Every care is taken to ensure that the price listings are correct,
however, on occasion technical or human error may result in an product
price being incorrectly listed. If this occurs, Wood N Workshop Pty Ltd
will correct the product price a soon as the error becomes known to Wood
N Workshop Pty Ltd.

Wood N Workshop Pty Ltd will not accept an offer to purchase a product
if the price is incorrectly listed. Wood N Workshop Pty Ltd will notify
you of the correct price as part of our sale procedures.

Products will not be dispatched until the total cost of your purchase is
received in full, in cleared funds. Wood N Workshop Pty Ltd will not be
liable for any delays or non-delivery due to unavailability of products
or payment clearance delays.

Payment for all products may be made by cheque/money order, credit/debit
card or bank transfer. Wood N Workshop Pty Ltd will not process any
payment for a product that has been incorrectly listed.

Delivery
Delivery of the product/s will be arranged to the address stipulated in
your registration form. It is your responsibility to check and update,
if necessary, your delivery address details each time you submit an
order (offer).

The delivery method that you have nominated at the time of placing your
order will be used unless alternative arrangements are made and agreed
to by written notice.

Ownership for the item passes from Wood N Workshop Pty Ltd to you at the
time the product is dispatched for delivery. Products will be at your
risk during delivery.

Consumer Rights
All transaction with domestic customers and products sold for domestic
use, as defined by Trade Practices Act 1974, are subject to the Trade
Practices Act 1974 and any other applicable Commonwealth or State laws.

Refunds
Every care will be taken to supply goods that
          - are of merchantable quality,
          - are fit for the purpose described,
          - match the description on this website; and
          - are free from defects and faults.

If you receive a product from Wood N Workshop Pty Ltd that is faulty,
defective or not suitable for the purpose described you should notify
Wood N Workshop Pty Ltd as soon as reasonably practicable after this has
been identified. Remedy and/or return options will be influenced by the
following factors.

If the product/s that are defective or faulty have had a fair amount of
use then you may only be entitled to a partial refund or a repair of the
product.

If the method or manner of how the product/s have been used has
contributed to or caused the fault any rights with respect to refunds or
other remedies will be affected.

All requests for a refund or alternative remedy for a product that is
faulty, defective or not suitable for the purpose described must be
accompanied by proof of purchase such as a receipt or credit record.

Wood N Workshop Pty Ltd does not offer a refund, credit or exchange if a
consumer has:
          - changed their mind, 

          - decided they no longer want the goods or just don’t like them, or

          - found that goods are the wrong size or colour; or

          - found they can buy the same or similar goods elsewhere for a cheaper price; or

          - examined goods before buying them and should have seen any fault at that time had a defect drawn to their          attention before they purchased goods, for example, when goods are clearly labelled as seconds or faulty.

Limit and Exclusion of Liability
The liability of Wood N Workshop Pty Ltd for any product defects or
faults or incorrect description is strictly limited to the consumer
protections available under section 68 of the Trade Practices Act 1974.

Wood N Workshop Pty Ltd directors and employees are excluded from any
liability, however arising (even if caused by a deliberate or negligent
act or omission by Wood N Workshop Pty Ltd directors, employees, agents,
distributors, or any third party providers) for any:

          - loss of income or revenue, and/or
          - loss of property or profits,  and/or
          - loss of business, and/or
          - loss of anticipated savings, and/or
          - any indirect or consequential loss or damage of any kind

resulting from a failure by Wood N Workshop Pty Ltd to meet its
contractual obligations.

The use of wood working products for business or hobby requires caution
and awareness of the associated risks. Product instructions and safety
precautions should always be fully adhered to. Wood N Workshop Pty Ltd
recommends the use of protective eyewear, earmuffs and face masks at all
times, even if not stipulated in the product instructions. Wood N
Workshop Pty Ltd directors and employees are excluded from any
liability, for any loss or injury resulting from the use of any products
sold by Wood N Workshop Pty Ltd, irrespective of whether the injury or
loss was the result of correct or incorrect use of the product or a
product fault or defect.

Indemnity

Wood N Workshop Pty Ltd directors and employees are indemnified from and
against any or all third party claims, demands, liabilities, costs or
expenses, including reasonable legal fees, relating to any product sold
by Wood N Workshop Pty Ltd that Wood N Workshop Pty Ltd did not fully or
partially manufacture.
